CCPA (California Consumer Privacy Act)

California law that gives residents control over their personal data, like the right to delete it.

What is the CCPA, and do I need to comply with it if I sell to customers in the United States?

The CCPA (California Consumer Privacy Act) was passed in 2018 and was the first broad consumer privacy law passed in the United States. In 2020, Proposition 24, known as the CPRA, expanded it, and those changes have been in effect since January 1, 2023. It is enforced by the California Privacy Protection Agency.

It applies to for-profit businesses that collect consumer data and meet at least one condition: annual revenue of $26,625,000 USD or more (the threshold in effect since January 1, 2025), buying, selling, or sharing the data of 100,000 or more California residents or households, or getting half or more of their revenue from selling or sharing that data. It gives people the right to know what is collected about them, delete it, correct it, opt out of its sale, limit the use of sensitive data, and not be discriminated against for exercising those rights.

Why it matters to your business

A small Colombian company selling services to clients in California is unlikely to reach those thresholds, but a business that grows on traffic from the United States can get closer, especially in terms of how many people's data it handles. Having a written privacy policy from the start, along with the option to delete data when someone asks, costs little and saves you from rebuilding the system later.

How we use this at Damorus

We do not yet have a client subject to the CCPA. Our concept sites for U.S. businesses, Pastime Lanes in Nebraska and The Medspa by Rayray in Texas, do not store visitor data: the first site's forms never send information to any server, and the second one's form simply opens the visitor's own email client. When a project handles data belonging to California residents, we will check the thresholds against the official source before designing any forms or databases.
